JUST SAY NO. The TPP isn't a trade deal, it's a grotesque expansion of corporate rule, which has already been such a disaster for the U.S. and the world. Arguably its worst aspect is allowing corporations to sue governments to avoid compliance with the law. This not only puts corporate profits above the law (although "our" government has been treating them that way for several decades now), but explicitly gives corporations more rights than human beings. That is absolutely unacceptable, and it cannot be fixed. This toxic deal must be defeated.

BECAUSE OF ITS ISDS PROVISION TPP MUCH WORSE THAN MOST PEOPLE REALIZE

I'm a retired physicist who has studied trade treaties for two years and the following summary is not shooting from the hip: If the enabling legislation for TPP is passed, almost all Progressive laws and policies at the local, state or national level could be "vetoed" by multinationals using the ISDS provision in TPP. The decision is based solely on whether a law or policy causes a multinational to lose current or projected future profit. Decisions are not made by a US or other national court but by a Tribunal of corporate attorneys many of whom, after their term on the Tribunal ends, return to their jobs working for multinationals.

EXAMPLES OF LEGISLATION/POLICIES THAT COULD BE "VETOED" UNDER TPP
-- a minimum wage law (that increases the expenses of a multinational)
-- an environmental law (that increases the expenses of a multinational)
-- any other law or policy that increases the expenses of a multinational thereby
decreasing its profit.
-- any law or policy that reduces the use of fossil fuels or provides a clean energy
technology with a temporary advantage in the marketplace to speed its deploy-
ment. (It is "illegal" under TPP to reduce the size of a multinational's market -- in
this case the market for fossil fuels -- thereby decreasing the projected future
profit of a transnational energy company.
-- Nations must choose between clean-energy and TPP because choosing one
precludes the other!

WHY ISDS IS MUCH MORE POWERFUL IN TPP THAN IN PRIOR TRADE TREATIES
Because:
(1) Not every multinational is allowed to use the ISDS provision. However the number of "approved" multinationals that are permitted to use the IDSD provision in TPP has been greatly expanded compared to previous trade treaties. This is likely to result in many more multinationals bringing suit before the ISDS Tribunal in TPP to "veto"our laws and policies.

(2) The ISDS Tribunal has "acted as it's own Supreme Court" in previous trade treaties starting with NAFTA. The Tribunal, in previous trade treaties, created, important "legal precedents" which can now be used in unique ways in TPP -- ways that were never intended by most legislators who voted for NAFTA -- to invalidate our laws and policies .
Just as the US Supreme Court creates important legal precedents that change the meaning and interpretation of our laws, in a similar fashion the ISDS Tribunal did the same thing in prior trade treaties. The tribunal then used its own precedents to decide suits brought before it by multinationals in prior trade treaties. The Tribunal is now prepared to use this accumulation of legal precedents in TPP. (The Tribunal created its precedents in suits brought before it by multinationals suing mostly poorer developing nations.)

CONCLUSION
The accumulation of precedents has now reached the point where it would be "illegal" in TPP for a member nation to pass any law, or adopt any policy that, directly or indirectly, decreased the current or projected future profit of an "approved" transnational doing business in that country! This, in turn, would transition democratic member nations of TPP like the US, from democratic-decision-making to rule by multinationals!
